Sandy Recovery, JCP&L Review Top Council Agenda

The Chatham Borough Council meets Monday.

In their first meeting since Tropical Storm Sandy hit the area, the Chatham Borough Council will review emergency management and JCP&L's performance during the storm when they meet Monday. Much of Chatham Borough lost power as a result of Tropical Storm Sandy, including all schools, and police said trees or wires came down on almost every street. According to the First Energy website, all of Chatham Borough has had power restored as of 11 p.m. Sunday. In 2011, borough residents and officials criticized JCP&L's slow response to restoring power after both Tropical Storm Irene and the late October snow storm that hit exactly one year before Sandy. Gambling Addiction Center Changes Inn's Use, Judge Rules

Morris County judge also denies application for sixth amendment to lawsuit and Tricare's motion for protective order.

Several rulings on pretrial motions in Tricare Treatment Services' lawsuit against Chatham Borough came down Tuesday, mostly in favor of the borough. The most significant ruling by Judge David B. Rand, sitting in Morristown, was that the borough's Zoning Board of Adjustment made an "appropriate" decision in March 2010 when it ruled that Tricare wanted to extend, not continue, a preexisting nonconforming use at the Parrot Mill Inn. As an inn, Rand said, "the facility was open to the general public where rooms were made available and breakfast was served." Tricare's application to the Chatham Borough Planning Board to use the building as a treatment facility for compulsive gamblers "fundamentally changed the nonconforming use," Rand said. "…

Tricare Hearing Postponed in County Court

Several motions will be heard before Judge Rand on Tuesday.

The hearing in the matter of Tricare Treatment Services' ongoing lawsuit against Chatham Borough was postponed from its scheduled date Thursday to Tuesday, Sept. 11, according to NJ.com. The borough's attorney in the matter, Denis Driscoll, said there are several motions to be heard by the Hon. David Rand before trial begins on Sept. 17. Tricare, a gambling addiction treatment company, filed a lawsuit in state Superior Court in Morristown May 13, 2010 against the borough's Zoning Board of Adjustment, Planning Board, council and then-Mayor Nelson Vaughan. The suit was filed after Tricare, which is owned by Michael Osborne, attempted to establish a gambling addiction treatment center at the Parrot Mill Inn. The borough's Zoning Officer, …

Tricare Lawsuit Postponed to September

The judge in the case was ill at the date of the last hearing, according to borough's attorney.

Denis Driscoll, the litigation counsel for Chatham Borough in the ongoing lawsuit against Tricare Treatment Services, said attorneys for Tricare and the borough will appear before the Hon. David Rand on Sept. 6. "There are a number of pending motions," Driscoll said, though trial is several weeks off. Depositions and other discoveries have been ongoing for over a year, since before Driscoll came on as the borough's attorney. Several Chatham residents have given depositions in the case already. Not surprised that the Chatham boobs on the board blew this (and will now cost the town potentially big bucks!). Tricare Lawsuit Still in Discovery Phase

No word yet on a trial date.

Denis Driscoll, the attorney for Chatham Borough in the ongoing lawsuit against Tricare Treatment Services, confirmed Monday the lawsuit is still in the discovery phase. Depositions and other discoveries have been ongoing for over a year, since before Driscoll came on as the borough's attorney.
